In the past I have typically represented franchisors, not franchisees. But I was contacted by an attorney in New York who asked me to handle the matter as local counsel. I had no conflict of interest, and I thought the client had a good case, so I took the representation. Now that the case goes to arbitration my representation ends, and some of my attention can be redirected to my other cases. </description>

      <description>I’ll be speaking at the LSBA’s summer re-run seminar about ‘Ethics &amp;amp; E-Discovery’.  Most lawyers face a big struggle with E-Discovery.   If they understood the nature of digital information better they wouldn't have so many problems with E-Discovery.  Hopefully, I’ll be able to offer the attendees some practical solutions to this rapidly increasing problem.</description>

The focus will be about gathering digital information.  Criminal lawyers face the stark reality that their client’s words and actions are being captured in many digital forms: surveillance cameras, text messages, Thumb-drives, web-browser history and so on.&lt;br/&gt;&lt;br/&gt;First, you have to be aware that such information might exist and then figure out how to deal with it.  Law enforcement officials learn about the relevant digital information while building their case first, which gives them a double advantage.  Defense lawyers have to understand the digital issues well before the client calls to say he’s in trouble.</description>
